1. Scope
These Terms of Service apply to use of the online service Kessly, operated by EXCIT3D GmbH, Mankhauser Str. 1, 42699 Solingen (“Provider”).
Conflicting terms of the user are not accepted unless expressly agreed in writing.
2. Service description
Kessly converts online recipes into Thermomix-compatible instructions. The service is provided as software-as-a-service (SaaS) over the internet.
The Provider does not guarantee uninterrupted availability at all times but endeavours to ensure smooth operation. Maintenance may cause temporary restrictions.
Converted recipes are provided as guidance only. Users are responsible for proper preparation and food safety.
3. Registration and account
Use requires a user account. Registration is via email and magic link.
Users must provide accurate information and keep access credentials confidential.
Each user may only create one account.
4. Free use and subscription
New users receive two free recipe conversions.
Unlimited conversions require a paid monthly subscription. The current price is shown on the pricing page.
A subscription contract is formed upon completion of payment via Stripe.
Subscriptions renew automatically for one month unless cancelled.
5. Payment
Payments are processed via Stripe. Prices shown include applicable VAT where required.
In case of payment default the Provider may suspend access to paid features.
6. Cancellation
Subscriptions can be cancelled at any time effective at the end of the current billing period via account management (Stripe Customer Portal).
Users may delete their account at any time in profile settings.
The right to extraordinary termination for good cause remains unaffected.
7. Usage rights and third-party content
Users may only submit recipes they are legally permitted to process. Users indemnify the Provider against third-party claims arising from unlawful use.
The Provider respects robots.txt directives of source websites and processes only publicly accessible content within technical limits.
8. Liability
The Provider is fully liable for intent and gross negligence and for injury to life, body or health.
In case of slight negligence the Provider is liable only for breach of essential contractual obligations, limited to foreseeable, typical contract damage.
Liability for the accuracy of automated recipe conversions is excluded to the extent permitted by law.
9. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection provisions of the user's country of residence in the EU remain unaffected.
Place of jurisdiction is, where permitted, Solingen.
If individual provisions are invalid, the validity of the remaining provisions is unaffected.
